§1 ACCEPTANCE AND ELIGIBILITY
By downloading, installing, creating an account, or otherwise accessing or using the Samevian mobile application and related services (collectively, "Service", "we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all Terms, you must immediately stop using the Service.
You must be at least 13 years of age to create an account and use the Service, in accordance with the United States Children's Online Privacy Protection Act (COPPA) and the GDPR provisions applicable to children (GDPR-K). Career-track, financial-literacy, and market-analysis modules are restricted to users aged 18 years and older, in compliance with International Labour Organization Convention 138 concerning minimum age for admission to employment. Users between the ages of 13 and 17 must obtain verifiable parental or legal guardian consent before using any age-gated feature.
§2 ACCOUNT AND SECURITY
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@samevia.com if you become aware of any actual or suspected unauthorised access to your account. We will never request your password by email, in-app message, or any other channel.
§3 LICENCE GRANT
Subject to your compliance with these Terms, Samevian grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the Service solely for your own personal, non-commercial educational purposes. You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the Service or any portion thereof.
§4 ACCEPTABLE USE
You agree that you will not, directly or indirectly: (a) use the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation; (b) attempt to probe, scan, or test the vulnerability of any system or network, or breach any security or authentication measures; (c) distribute, transmit, or facilitate any malicious code, virus, or other harmful software; (d) engage in automated data collection, scraping, crawling, or harvesting of any content from the Service without our prior written consent; (e) impersonate any person or entity or misrepresent your affiliation with any person or entity; (f) circumvent, disable, or interfere with subscription entitlements or content-access controls; (g) use AI-generated educational content as a substitute for professional, legal, medical, financial, or other expert advice; or (h) harass, abuse, threaten, or intimidate any other user or member of our team.
§5 USER CONTENT
Any content you voluntarily submit through the Service, including without limitation quiz responses, AI interaction prompts, written feedback, and profile information ("User Content"), remains your sole property. By submitting User Content, you grant Samevian a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, reproduce, process, adapt, and display that User Content solely to the extent necessary to provide, maintain, and improve the Service. We will not use your User Content to train third-party artificial intelligence models without your separate and explicit informed consent.
§6 INTELLECTUAL PROPERTY
All content, software, algorithms, interfaces, course materials, trademarks, service marks, trade names, logos, and design elements made available through the Service are owned by or licensed to Samevian and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in or to any Samevian intellectual property beyond the licence expressly set out in §3. All rights not expressly granted herein are reserved.
§7 SUBSCRIPTIONS AND BILLING
Certain premium features of the Service are available only through a paid subscription. A subscription is attached to your account and unlocks both this website and the Android app, regardless of which one you bought it from.
Subscriptions purchased on this website are sold and processed by our merchant of record, who is the seller for tax purposes and issues the invoice. Subscriptions purchased inside the Android app are sold and processed by Google LLC through the Google Play Store under its own terms. In neither case does Samevian store, access, or process your payment card or banking details.
Subscriptions renew automatically at the end of each billing period until cancelled. For a subscription bought on this website, renewal, cancellation and refunds are governed by the Subscription terms, cancellation and refunds page, and you cancel from Settings. For a subscription bought through Google Play, cancel through Google Play at least 24 hours before the renewal date — navigate to Google Play Store, then Subscriptions, and select the Samevian subscription — and refund requests are subject to Google Play's refund policy.
Statutory rights in your country apply on top of this section and are never reduced by it.
§8 DISCLAIMERS OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT ANY WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. SAMEVIAN EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. EDUCATIONAL CONTENT DOES NOT CONSTITUTE PROFESSIONAL, LEGAL, MEDICAL, FINANCIAL, OR CAREER ADVICE. AI-GENERATED CONTENT MAY CONTAIN INACCURACIES OR ERRORS; YOU MUST INDEPENDENTLY VERIFY ANY CRITICAL INFORMATION BEFORE RELYING UPON IT.
§9 LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAMEVIAN, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, OR SYSTEM FAILURE, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY. IN ANY EVENT, SAMEVIAN'S MAXIMUM AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNTS YOU HAVE ACTUALLY PAID TO SAMEVIAN IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) EUR 50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
§10 INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Samevian and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; (c) your use of the Service in a manner not authorised by these Terms; or (d) your violation of any applicable law or the rights of any third party.
§11 TERMINATION
You may terminate your account at any time by navigating to Settings, then Account, then Delete Account. Upon deletion, your personal data will be erased within 30 days in accordance with GDPR Article 17 (right to erasure), subject to any legal retention obligations. Samevian reserves the right to suspend or permanently terminate your access to the Service at any time, with or without notice, if we determine in our sole discretion that you have materially violated these Terms, applicable law, or the rights of any third party.
§12 PRIVACY AND DATA PROTECTION
The collection, processing, storage, and international transfer of your personal data are governed by our Privacy Policy, accessible via Settings, then Privacy Policy. Key data-protection commitments: (a) personal data is stored on servers located in the European Union operated by Supabase, encrypted at rest using AES-256 and in transit using TLS 1.3; (b) on-device data is encrypted using SQLCipher AES-256; (c) pseudonymised usage analytics are retained for a maximum of 24 months; (d) audit and compliance logs are retained for 7 years; (e) under GDPR, CCPA, and CPRA, you have the right to access, correct, delete, port, restrict, or object to processing of your personal data, and California residents have the right to opt out of the sale or sharing of personal data — to exercise any of these rights, use the in-app Privacy controls in Settings or send a written request to support@samevia.com.
§13 CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. We will notify you of material changes that affect your rights via an in-app notification at least 30 days before the revised Terms take effect. Your continued use of the Service after the effective date of any revision constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account before the effective date.
§14 GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and any dispute, claim, or controversy arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the Republic of Armenia, without regard to its conflict-of-law principles. Before initiating any formal legal proceeding, both parties agree to attempt to resolve any dispute in good faith through informal negotiation for at least 30 days. If the dispute is not resolved informally, it shall be referred to binding arbitration in Yerevan, Armenia, in accordance with the arbitration rules applicable in that jurisdiction. Notwithstanding the foregoing, either party may seek interim injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.
